Evidence

Instruction No.

In considering this case, you should not indulge in any mere conjectures, surmises or suppositions as to what may or may not have occurred, but you must decide the case upon the evidence offered and admitted in open court.

Offered testimony, to which objection was sustained, or which was stricken out by order of the court, is not before the jury, and should not be considered in arriving at your verdict.

Statements of counsel for either side which are unsupported by the evidence, if any such statements have been made, should not be considered.
